Element Vehicle Management Services Group, LLC, doing business as Element Fleet Management and its affiliates (collectively, “Element Fleet Management,” “we,” “us,” or “our”) provides this Privacy Notice to describe how we collect, use, and share information about individuals who visit our website at www.elementfleet.com (“website”) and use our services, including information we collect offline to provide those services.
This Privacy Notice also applies to information about individuals that we collect or maintain through other websites, apps, or platforms that link to this Notice, such as Element ONE and Element Pay (collectively with the website, the “Services”). Information Collection
Website Users
You may provide information about yourself including your name, company name, mailing address, email address, phone number, vehicle information, and total fleet size. We may collect this information when you register on our website or request information or a service from us.
Clients and Drivers
We and our agents may also collect the following information in the course of providing our Services, including vehicle management and leasing services. For example, we may collect this information when clients or drivers provide information through Element ONE or Element Pay, or when clients execute agreements with us to receive other Services. We may collect this information directly from you, from your employer or fleet administrator, from banks, or from other third parties.
Identity information including your name, company/employer name, mailing address, email address, job title, phone number, and driver’s license information;
Account information including username, password, employee ID, and authorized signatory information;
Vehicle and fleet information including Vehicle Identification Number, license plate number, odometer readings, and, depending on the Services, information collected directly from your vehicle or a connected device, including location information, vehicle diagnostic information, and fuel or electric usage information;
Insurance information including policy details and driving records; and
Financial and transaction-related information including payment card number, bank account information, transaction amounts, transaction dates/times, merchant names and category codes, payment history, credit and underwriting data, billing and invoice records, and other transaction-related data associated with your use of the Services.
Job Applicants
If you apply for a job, we will collect any information you provide in your application, including, but not limited to, educational background, employment history, and references.
All Users
We (and other entities) automatically collect information relating to your interactions with us and our Services, including browser type, IP address, pages visited and other activities on the website or other Services, device type, time and date of visit, and other information we collect through the use of cookies and similar technology. How We Use Personal Information
We may use the information we collect for any lawful purposes, including the following:
To provide vehicle management, leasing, fuel payment, and other products and Services to you;
To respond to your inquiries and requests, including to respond to contact, customer service, or consultation requests;
To communicate with you, including to send you announcements and alerts and to provide newsletters, updates, surveys, emails, marketing materials, and other content that may be of interest to you;
To maintain, operate, customize, and improve our website, products, and Services, including for advertising or analytics purposes;
To comply with applicable legal and regulatory obligations, respond to law enforcement, and maintain the security of our website, Services, rights, and property; or
With your consent, or as otherwise disclosed at the time of collection or use.

How We Share Personal Information

With third-party service providers who process information on our behalf, such as payment processors, data hosting services, email service providers, and other vendors to help perform the services you request, or with our legal or business advisors;

Digital Advertising & Analytics
We may partner with ad networks and other ad serving providers (“Advertising Providers”) that serve ads on our behalf and others on non-affiliated platforms. Some of those ads may be personalized, meaning that they are intended to be relevant to you based on information Advertising Providers collect about your use of the Services and other sites or applications over time, including information about relationships among different browsers and devices. This type of advertising is known as interest-based advertising.
Element Fleet Management adheres to the Digital Advertising Alliance (“DAA”) Self-Regulatory Principles in connection with this interest-based advertising activity. You may visit the DAA Webchoices tool at www.aboutads.info to learn more about this type of advertising and how to opt-out of this advertising on websites by companies participating in the DAA self-regulatory program. Element Fleet Management uses Google Analytics and other third-party services to improve the performance of the Services and for analytics and marketing purposes. SMS/Text Messages
When you provide your mobile phone number and opt in to receive SMS communications from us, we may use your phone number to send transactional, operational, account-related, fleet vehicle and/or service-related, and other business communications. Message and data rates may apply. During our communications, we may collect your mobile phone number, consent records associated with SMS opt-in, and messaging interaction data, including delivery confirmations and opt-out requests. We use this information to deliver SMS communications, provide business notifications and messages, respond to your or your employer’s inquiries, maintain records of consent and communication preferences, and comply with applicable legal and regulatory obligations. Your mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent may be shared with vendors, consultants, or service providers that support the delivery of SMS messaging services.
You may opt out of receiving SMS messages at any time by replying STOP to any message received from us. Reply HELP for additional assistance or contact us directly as indicated in this policy with questions or requests.
Third Party Links & Tools
Our Services may provide links to third-party websites or apps. We do not control the privacy practices of those websites or apps, and they are not covered by this Privacy Notice. You should review the privacy notices of other websites or apps that you use to learn about their data practices.
The Services also include integrated social media tools or “plug-ins,” such as social networking tools offered by third parties. If you use these tools to share personal information or you otherwise interact with these features on the Services, those companies may collect information about you and may use and share such information in accordance with your account settings, including by sharing such information with the general public.

Data Security
We maintain administrative, technical, and physical data security measures designed to help protect the information we collect from unauthorized access or interception. We also implement processes designed to comply with applicable Payment Card Industry Data Security Standard requirements applicable to use, storage, or transmission of service card and cardholder data in connection with our Services.

Addendum – GLBA Privacy Notice
Through Element Pay, Element Fleet Management partners with banks and/or credit unions to provide certain products and Services. We are committed to protecting nonpublic personal information (“NPI”) in accordance with the requirements of the Gramm-Leach-Bliley Act and other applicable laws. This section governs NPI collected when you sign up for Element Pay or obtain another financial product or service from us.
Categories of Information Collected
We may collect the following categories of NPI from a variety of sources, including:
Information you provide to us on applications or other forms, such as your name, address, phone number, email address, employer name, and financial account information;
Information about your transactions with us, banks and/or credit unions, or others, such as transaction amounts, dates, merchant information, and payment history; and
Information we receive from third parties, such as credit reporting agencies and the banks and/or credit unions we partner with, including credit history and account status information.
Information Sharing Practices
We may use and share NPI with the following categories of entities for the following purposes:
Banks and/or credit unions, as necessary to operate our products and comply with banking regulations;
Our corporate affiliates, for the business and marketing purposes described in this Privacy Policy;
Non-affiliated third-party service providers that perform services on our behalf under written agreements; and
Non-affiliated third parties as permitted or required by law, including for fraud prevention, regulatory compliance, and in response to legal process.

Your GLBA Opt-Out Rights
You have the right to opt out of certain sharing of NPI with non-affiliated third parties. Specifically, you may opt out of:

Sharing of NPI with our affiliates for marketing purposes based on your transaction history or other information we collect about you.
